TOPICS TO BE COVERED:

Background

The General Data Protection Regulation (“GDPR”) will have a significant impact on Irish domestic insurers. This briefing will deliver insights into the major changes that will be introduced when the GDPR comes into force on 25 May 2018, in particular the impact on domestic insurers, brokers and consumers. The speakers will also discuss the steps that insurers should take in order to prepare for what will be the biggest change to data protection laws in over 20 years.

Key Points for the Insurance Sector to be aware of:

  • Impact of GDPR on insurance product design, distribution and areas such as direct on-line sales
  • Operational redesigns for insurers in light of GDPR and new functions such as the obligation for insurance groups to have a data protection officer
  • Extension of Liability – responsibility for privacy breaches will extend to both data processors and data controllers and potentially extends liability of insurers to distributor breaches
  • Stricter rules on automated decision making are likely to impact the various technologies deployed within the insurance sector to aggregate and analyse data such as big data analytics, profiling and telematics including use of aggregate data in pricing and reserving
  • Unlocking the value of data in areas such as cross-selling of insurance products and ownership of client lists in a “GDPR world”
  • GDPR and the “insurance cycle” – impacts from marketing and inception of policies through to administration and claims settlement
  • Lead Authority Mechanism – insurance groups with operations in more than one Member State will be principally regulated by the data protection authority in the Member State where they have their “main establishment”
  • Nature of Consent and Right to be Forgotten
  • Data Portability – organisations must be able to export data in a structured, commonly used and machine readable form
  • Compliance changes for insurers in areas like Data Privacy Impact Assessments, Security Breach Reporting and Record Retention and Management
  • Dawn raids and GDPR – parallels with the competition regime and recent Irish insurance experiences
  • Increased Penalties and Claims
